Contracts can be in English and/or Chinese, and must be in writing and signed by both parties.
Key details include the employee's name, start date, length of employment, position and responsibilities, working hours, remuneration, labor protections, and termination conditions.
In Shanghai, contracts can be established in English with mutual consent.
Working Hours and Overtime
In China, standard working hours are 8 hours per day and 40 hours per week, typically Monday to Friday. Overtime pay is mandatory for hours beyond standard working hours, with rates ranging from 150% to 300% of the hourly rate. Employees can work up to 3 hours of overtime per day and 36 hours per month.
Notice Period
The minimum notice period is 1 month and can be increased based on the employer’s discretion.
Probationary Period
Probation periods vary based on the length of employment:
Less than 1 year: Up to one month
1-3 years: Up to two months
3 or more years: Up to six months
Termination during probation requires valid cause and proof.

Minimum Wage Requirements
The minimum wage in China is based on region or municipality. The minimum wage in Shanghai is RMB 2,590 and RMB 2,320 in Beijing.
Individual Income Tax
The individual income tax ranges from 3% to 45%, following progressive brackets based on gross annual income. For instance, income below RMB 36,000 incurs a 3% tax, while income above RMB 960,000 is taxed at 45%.
Payroll Cost
Employer costs vary by region; in Shanghai, it's estimated at 36% of the employee's salary. Components include contributions to the Pension Fund, Health Insurance, Unemployment Fund, Work Injury Fund, Maternity Leave, Housing Fund, and Disability Fund.

Pregnant employees who have worked for the same employer for at least 80 days in the past year are eligible for 26 weeks of paid maternity leave, with a maximum of 8 weeks before childbirth. The employee receives 100% of their average salary during this period, and the employer is responsible for payment.
Paternity Leave
There is currently no legal requirement for paternity leave in China, although some employers may offer it voluntarily.
Shared Parental Leave
Parental leave varies based on the region that the employee is based in. In some regions, both parents can take 5-15 days of parental leave per year until the child turns 3, with the base salary provided.
Sick Leave
Employees are entitled to paid sick leave for up to 180 days, with payment rates and payers varying based on length of service.

Termination Requirements
Terminations in China must adhere to complex rules, with no at-will termination outside the probation period.
Compliance with termination regulations varies by province and region.
Permissible terminations include voluntary resignation, mutual agreement, and unilateral termination by the employer based on probation, objective grounds, disciplinary dismissal, performance, or contract expiration.
Notice Period
The minimum notice period is 3 days during probation and 30 days post-probation, subject to additional local regulations.
Severance for Employees
Severance pay in China depends on the length of employment and varies by province.
Termination without cause may result in severance pay ranging from half to one month's salary per completed year of service, up to a maximum of 12 months' salary.
Severance pay is not required for termination due to serious breach of employment contract by the employee.
For fixed-term contracts, severance pay is calculated at one day's salary per completed year of service.

Paid Time Off
Both full-time and part-time employees are entitled to paid time off (PTO) annually. PTO accrues monthly, with increments based on the length of employment. Employees are eligible for PTO after one year of service. Accumulated PTO varies:

More than 20 years of service: 15 working days
